The seller shall sell the goods in an electronic way in accordance with the following rules of sale in an electronic way, hereinafter referred to as the 'rules'. The rules are provided to buyer free of charge, before concluding an agreement - and on demand of the customer - in a way, which enables to obtain, use and record full text of the rules by means of computer systems used by the customer.

1. General rules about the seller.
   
   
   1. The seller and the owner of the service / internet shop is VITAPOL - FARM Spółka z o.o., with registered office in Sulejówek (05 - 077), ul. Miła 3, hereinafter referred to as the Seller.
   2. Address for correspondence: VITAPOL - FARM Sp. z o.o., ul. Miła 3, 05 ? 071 Sulejówek.
   3. Information about registration: The company is registered in District Court in Warsaw, XXI Department of National Court Register under the KRS number 0000113131. Identification number REGON 010429304. Tax identification number NIP 118 00 52 676. The Seller's bank account number 04124010951111000003363788 X division: Warsaw, ul. Płowiecka 1/3 04 - 501.
   4. Using this VITAPOL - FARM Spółka z o.o. service / shop means accepting the rules herein.
   
   
2. The subject of the offer
   
   The subject of the offer of VITAPOL - FARM Spółka z o.o. service / shop are vitamin and vitamin - mineral products produced by Vitapol - Farm, which are dietary consumable products and dietary supplements, as defined in Ordinance of Minister of Health, dated 23 December 2002 concerning consumable products of special dietary purpose (Dz. U. z 31.12.2002, Nr 239, poz. 2050), and Ordinance of Minister of Health, dated 19 December 2002 concerning dietary supplements (Dz. U. z 17.02.2003, Nr 27, poz. 236), hereinafter referred to as non-prescription 'products'.
   
   
3. Special offers.
   
   The Seller may offer temporary sale promotions of goods - 'special offer'.
   
   
4. Ordering rules.
   
   
   1. By means of internet shop - click on a link "Włóż do koszyka" (Place in my basket) placed by the product. After putting all interesting products into your basket, click on "Zamawiam" (Order).
   2. By means of e-mail - on the e-mail address biuro@viapolfarm.com.pl. Please send the name and quantity of a chosen product, buyers data (company name / surname and forename, address, telephone number and e-mail address) and address of dispatch (company name / surname and forename, address, telephone number) if different from the buyer's address, and the type of a dispatch - as a normal or registered delivery.
   3. By means of telephone - by telephone: (22)783 - 96 - 25 (between 8 a.m. and 4 p.m.) or by fax: (22)783 - 96 - 55, providing all the necessary information as in point IV.2 above.
   4. Orders made by means of internet shop or e-mail can be made 24 hours a day for the whole year.
   5. While placing the order, the Buyer is obliged to provide telephone number and e-mail address, which are necessary in case of various unexpected situations. Placing correct order by the Buyer means concluding an agreement between the Buyer and the Seller. In various unexpected situations the agreement shall be concluded after obtaining confirmation form the Buyer.


5. Dispatch of the goods.
   
   
   1. The Seller sends the ordered goods on the first working day following the day, when the goods were ordered by the Buyer.
   2. Ordered goods shall be dispatched to the Buyer by means of Poczta Polska S.A. (Polish Post).
   3. The goods shall be dispatched at the address provided by the Buyer together with the order.
   4. In case of the Buyer being absent, Poczta Polska S.A. employee shall leave a notice for the Buyer to collect the dispatch from the post office (advice note).
   5. The Seller, together with the dispatch, shall always send an invoice, which is a proof of buying the goods.


6. Time of completing the order, possibility of resignation.
   
   
   1. The time of waiting for the order shall be counted from the day of placing the order by the Buyer, in compliance with rules herein.
   2. The time of waiting for the ordered product shall be 7 working days in case of normal dispatches, and 4 working days in case of registered delivery. The time of completing the order may change if the Buyer makes alternations in the order.
   3. In case of a shortage of ordered goods, the Buyer shall be informed about existing situation and elongated time of completing the order. In this kind of situation the Buyer has right to contract out of the agreement.
   4. The Buyer may resign from the order, informing the Seller about it in a written form (e-mail: biuro@vitapolfarm.com.pl fax: (22) 783 - 96 - 55 or by phone: (22)783 - 96 - 25), no later than till 11 a.m. of the day following the day of placing the order.
   5. In case of the goods not being collected by the Buyer and lack of resignation notice complying with aforementioned rules, the Seller shall charge the Buyer with the costs of dispatching of the ordered product to the Buyer and returning them to the Seller.
   
   
7. Prices.
   
   
   1. All the prices of the products are stated in Polish zlotys and include all currently binding taxes on offered products in the Republic of Poland, together with VAT.
   2. The Seller stipulates the right to change prices. During order realization the prices shall be calculated in accordance with the prices from the day of placing the order.
   3. The cost of the dispatch for the products not exceeding 150.00 zlotys shall be born by the Buyer.
   4. The costs of the dispatch for the products worth at least 150.00 zlotys shall be transferred to the Seller. The Seller shall send ordered goods as a normal dispatch.
   5. Cost of COD dispatch equals 8.00 zlotys in case of normal dispatch and 9.00 zlotys in case of registered delivery less than 0,5 kg. These costs include a charge for Poczta Polska S.A,. amounting to 5.00 zlotys in case of normal dispatch, and 6.00 zlotys for packs to 0,5 kg in case of registered delivery, and a charge for bank money transfer on the account of the Seller. Packs between 0,5 kg and 1 kg costs costs 10 zlotys for normal dispatch and 11 zlotys for registered delivery .Packs from 1 kg to 2 kg costs 11,50 for normal dispatch and 12,50 for registered delivery . Packs from 2 kg to 5 kg costs 13,00 for normal dispatch and 13 zlotys for registerd delivery.
   6. In case of making an advance payment, mentioned in part VIII point 3, the cost of dispatch does not include the charge for the bank money transfer on the Seller's account. The advance payment should also include postal charge: 5.50 zlotys for normal dispatch and 6.50 zlotys for registered delivery for 1 kg pack. Packs over 1 kg to 2kg - 7,00 zlotys for normal dispatch and 8,00 for registered delivery. Packs between 2 and 5 kg costs 8,50 zlotys for normal dispatch and 9,50 zlotys for registered delivery.
   7. In case of the order exceeding 150.00 zlotys, the Buyer making an advance payment shall not bare the costs of postal charge.


8. Forms of payment.
   
   
   1. Payment for the goods and their dispatch, complying with points 3 and 4 of part VII and point 3 of this part, shall be made on delivery, with cash.
   2. Formalities connected with accounting for the transaction shall be made in the place of collecting the dispatch. The formalities shall be carried out by the employee of Poczta Polska S.A. - the courier.
   3. There is a possibility to make an advance payment on the Seller's bank account provided in "General information about the Seller", in compliance with part VII point 6 of the rules herein.


9. Complaints.
   
   
   1. After paying the charge for the dispatch, the Buyer has right to check the contents of the dispatch in the presence of the courier in order to compare the goods with the order. In case of any inconsistencies, the Buyer should request making a complaint report by the courier or the employee of Poczta Polska S.A.
   2. The Buyer has right to make a complaint about the ordered goods in case of stating qualitative, assortment or quantitative defect. The complaint shall be forwarded to the Seller in a written form no later than 3 days after collecting the dispatch. The complaint shall be sent by e-mail at biuro@vitapolfarm.com.pl or by fax: (22)783 - 96 - 55.
   3. While making a return dispatch, the Buyer is obliged to send the product together with a letter explaining the reason for the complaint, proof of buying the goods (invoice or receipt), bank account number or address of sending the postal money order.
   4. The Seller shall assume an attitude towards the complaint within 14 days from the day of collecting the goods.
   5. In case of accepting the complaint the Seller is obliged to return the costs of the goods together with the costs of returning the dispatch. The return shall be made with a bank transfer to the bank account number or with a postal money order to the address, indicated by the Buyer. In this situation all the charges connected with transferring the amount due to the bank account or with a postal money order to the indicated address, shall be born by the Seller.
   6. The Seller does not accept COD dispatches.
   
   
10. Contracting out of the agreement.
    
    The Buyer has right to return the ordered product in an unchanged state within 10 days from the date of collecting the purchase, at his / her own expense, with a statement that he / she is contracting out of the agreement. The buyer is obliged to send, together with the returned goods, the proof of buying the product (invoice or receipt) and bank account number on which the Seller is to return the price of the product. The amount due may also be send with a postal money order on the address indicated by the Buyer. The returned amount is equal to the value of the ordered products (without costs of dispatch) reduced by the cost of charges connected with transferring the amount due on the Buyer's bank account or costs of postal money order. (In accordance with the Article dated 02.03.2000 concerning protection of consumer rights - Dz. U. z 31.03.2000 nr 22 poz. 271).
    
    
11. Final regulations.
    
    
    1. 1.Personal data protection: placing the order, the Buyer accepts all the above terms and conditions of the order and agrees on processing his / her personal data by VITAPOL - FARM Spółka z o.o. for marketing purposes. The company VITAPOL ? FARM Spółka z o.o. is obliged to protect personal data in accordance with the article dated 29 August 1997 concerning "protection of personal data" (DZ. U. nr 133 poz. 883). According to the article mentioned above, the Buyer has right to have an insight into his / her data, to change them and to forward a claim to cease using them for marketing purposes. VITAPOL - FARM Spółka z o.o. does not make accessible personal data to third parties. This statement concerns both address and e-mail data.
    2. All the situations not regulated by these rules shall be regulated by the regulations of the Civil Code.
